GM Rewards Experience Terms

These GM Rewards Experience Terms (the “Experience Terms”) are an agreement between you and General Motors LLC (“GM”), and supplement and incorporate by reference the GM Rewards Program Terms and Conditions. These Experience Terms govern your participation in GM Rewards Experiences (each an “Experience” or collectively, “Experiences”). GM reserves the right to modify these Experience Terms at any time without notice, effective upon posting or otherwise communicating the update to you. You agree to review these Experience Terms periodically to become aware of such modifications. Any violation of the terms of these Experience Terms may result in the suspension or termination of your right to participate in, or access, the GM Rewards Experiences. In addition, violation of these Experience Terms may be deemed by GM to be a breach of the GM Rewards Program Terms and Conditions.
Experiences may be provided by entities that are not affiliates of GM. These unaffiliated Experience providers are independent entities and are not agents or representatives of GM. GM is not responsible for, and assumes no liability for, the actions of an unaffiliated Experience provider. Nothing in these Experience Terms is intended to create any agency, partnership or joint venture between GM and any unaffiliated Experience provider. By offering an Experience provided by an unaffiliated Experience provider, GM does not endorse such entity. General Motors is not responsible for goods or services offered by any unaffiliated Experience providers.
Eligibility to Participate in GM Rewards Experiences
To redeem Points for a GM Experience, you must be a GM Rewards member who resides in the 50 United States or the District of Columbia. To join GM Rewards, enroll now.
Important Information about GM Rewards Experiences
Each Experience may include restrictions, such as age requirements. Each Experience may also require the Member to pay for transportation, meals, hotel, or other aspects of attendance at an Experience. If an Experience includes onsite talent, interactions such as meet and greet or similar are not guaranteed unless specifically identified in the Experience listing. Some Experiences may require a liability release to participate in the Experiences. Please review the individual Experience listing’s terms and conditions carefully before redeeming Points toward an Experience.
General Terms About GM Rewards Experiences
- The only accepted method of payment for an Experience is Points issued through the GM Rewards program.
- Your request to “redeem now” cannot be withdrawn once made.
- GM reserves the right to correct any typographical errors and to make changes, corrections or improvements to each Experience, and the description of each Experience, at any time without notice.
- GM may at any time amend, modify or supplement any terms and conditions applicable to an Experience.
- You may only “redeem now” for an Experience if you have a sufficient number of Points in your GM Rewards Member Account to cover the redemption.
- GM and its affiliates and service providers are not responsible for lost, interrupted or unavailable network server or other connections, miscommunications, computer or technical failure, or other error of any kind whether human, mechanical or electronic.
- If you have completed a “redeem now” redemption for an Experience, the number of Points equal to the “redeem now” purchase price will be deducted automatically from your GM Rewards Member Account. You will receive notification of your successful redemption and next steps via email.
- If you “redeem now” for an Experience, you must comply with all terms and conditions applicable to the relevant Experience.
- Experiences that require the physical shipment of items may only be shipped within the 50 United States and the District of Columbia.
- You may not assign, transfer, re-market, resell or otherwise dispose of an Experience.
- If you “redeem now” for an Experience, GM reserves the right to share your contact information (full name, email address, phone number, and mailing address) with any entity providing fulfillment of that Experience.
- Availability of all Experiences are subject to change, and if any Experience becomes unavailable for any reason, GM reserves the right, at its discretion, to substitute a substantially similar Experience or refund Points redeemed by a Member for the Experience.
Tax Implications
The monetary value of an Experience for which you redeem your Points may be considered taxable income from GM in the tax year in which you redeem the Points, in accordance with U.S. tax law. GM may be required to send you (and file with the IRS) a Form 1099-MISC (Miscellaneous Income) for the year in which you redeem your Points when the value of the Experience plus other taxable miscellaneous income you receive from GM totals $600 or more for a calendar year. You are responsible for any personal tax liability due to your point redemption. Please consult with your tax advisor.
Relationship
You acknowledge and agree that the relationship between you and GM is not a confidential, fiduciary, or other special relationship. You and GM are independent contractors, and no agency, partnership, or employer-employee relationship is intended or created by these Experience Terms.
General Release
To the maximum extent permitted by law, you hereby release and agree to hold harmless and indemnify GM, and its respective subsidiaries, affiliated entities, employees, directors, officers, attorneys, agents, joint venturers, licensees and assigns and each of their respective designees (“Released Entities”) with respect to any claims, damages, costs, losses and expenses, including reasonable attorneys' fees, due to, caused by, or arising out of:
- your redemption of Points toward a “redeem now” Experience;
- your use or receipt of any Experience obtained through GM Experiences;
- your participation in any Experience, including, but not limited to personal injury, property damage or other loss or costs sustained or incurred by you;
- your violation of these Experience Terms; or
- your violation of any law or the rights of a third party.
Failure by a Released Entity to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches.
No Warranty
GM makes no guarantees, warranties, or representations of any kind concerning the GM Rewards Experiences except as expressly contained in these Terms. You agree that GM has not represented that: (A) the GM Experiences will be uninterrupted, without omissions or error free; or (B) that defects will be corrected, or changes implemented. You release GM and its affiliates and service providers, from all liability regarding the earning, redemption, and use of Points, including any product, service or reward redeemed with Points that, after receipt, may be lost, stolen, or destroyed.
LIMITATION OF LIABILITY
GM PROVIDES EXPERIENCES “AS IS” AND, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. NEITHER THE RELEASED ENTITIES NOR ANYONE INVOLVED IN CREATING, PRODUCING OR DELIVERING GM EXPERIENCES, OR ANY EXPERIENCE OR SERVICE RELATED THERETO, SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR PARTICIPATION IN ANY EXPERIENCE OR YOUR INABILITY TO “REDEEM NOW.” THESE LIMITATIONS SHALL APPLY WHETHER FOR BREACH OR REPUDIATION OF CONTRACT, OR WHETHER IN TORT, CIVIL LIABILITY BY WAY OF NEGLIGENCE, GROSS NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. BY AGREEING TO THESE TERMS, YOU WILLINGLY AGREE THAT YOU HAVE RELINQUISHED YOUR RIGHT TO SEEK THESE DAMAGES FROM ANY RELEASED ENTITY AND THAT THIS IS A REASONABLE ALLOCATION OF RISK. THIS PROVISION DOES NOT APPLY TO NEW JERSEY RESIDENTS.
In the event GM is held liable for any act, error or omission related to an Experience for which you “redeemed now”, your sole and exclusive remedy will be limited to GM’s reissuance of Points you redeemed for that Experience. You agree to waive any claim or action of any kind in any forum that is not commenced and served on GM within one (1) year after the first occurrence of the kind of act, event, condition or omission upon which the claim or action is based.
Termination
GM has the right to terminate, suspend or cancel GM Experiences at any time, in GM's sole discretion. You understand and agree that the cancellation of your participation in GM Experiences is your sole right and remedy with respect to any dispute with GM arising out or relating to GM Experiences.
User Information
GM shall have the right, but not the obligation, to use your name, likeness, biography and other information about you in connection with any GM Experience for which you redeem Points.
Governing Law and Venue
The laws of the state of Michigan and federal law govern these Experience Terms and any aspect of your relationship with GM related to the Experiences. They govern without regard to any conflicts of laws principles that would cause the application of the substantive law of another jurisdiction.
Miscellaneous
If any provision of these Experience Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Headings are for reference purposes only and do not limit the scope or extent of such section. GM’s failure to act with respect to a breach by you or others does not waive GM’s right to act with respect to subsequent or similar breaches. These Experience Terms set forth the entire understanding and agreement between you and GM with respect to its subject matter.
